U.S. President Donald Trump signed two executive orders expanding the definition of categories not entitled to American citizenship by birth. These orders also aim to ban "birth tourism" in order to reduce immigration. These measures come after the Supreme Court's rejection in June of a previous attempt by Trump to limit the constitutional right to acquire citizenship through birth, which led him to call for legislation from Congress. Although there is no direct law preventing birth tourism, a federal regulation issued in 2020 effectively restricts the use of tourist and business visas for the purpose of giving birth to obtain citizenship, with provisions to hold those involved in fraud or related crimes accountable. It is estimated that between 20,000 and 25,000 women from abroad come annually for the purpose of giving birth, while the total number of births in the United States reached 3.6 million in 2025.
