The article highlights the historic decision of the Italian Supreme Court, which ended legal restrictions that prevented hundreds of thousands of descendants of Italians living abroad—especially in the Americas—from reclaiming Italian citizenship through descent. This ruling invalidated the previous interpretation of the law that prohibited transmitting citizenship to the children of migrants who had been conscripted by the countries they settled in, a consequence that impacted Gustavo Monstreyos’s family. The decision has enabled those on the verge of losing their citizenship rights, fostered equality among members of Italian expatriate communities, and opened the door for a broader process of reclaiming citizenship. However, subsequent restrictions introduced in 2025 laws have limited the full realization of these opportunities.
