President Donald Trump issued two executive orders aimed at expanding the definition of individuals who are not eligible for U.S. citizenship at birth, in an effort to reduce the phenomenon of "birth tourism," which takes advantage of the right to nationality law. The move primarily bans the use of tourist and business visas for the purpose of obtaining U.S. citizenship for babies born in the United States. Although there is no explicit law prohibiting "birth tourism," a federal regulation in effect since 2020 criminalizes these practices, and individuals involved can be prosecuted on charges of fraud or related crimes. The Center for Studies estimated in 2020 that between 20,000 and 25,000 women from abroad engaged in "birth tourism" between 2016 and 2017, while the number of U.S. births reached 3.6 million in 2025.
