Legal Responsibility in Medical Errors
The article discusses the issue of determining legal responsibility in cases of medical errors and complications that occur during treatment in Syrian hospitals. It clarifies that the law regulates the medical profession and requires the physician to exercise recognized care, along with obtaining the patient's consent and informing them of the risks. It also emphasizes that potential complications, which may happen even with full adherence to correct procedures, are not considered medical errors; however, a mistake by the doctor is when it causes direct harm to the patient due to negligence or misconduct. Medical expert committees are relied upon to assess cases, and legal procedures are controlled between two pathways: criminal and civil. Additionally, disciplinary councils within the professional syndicate exist to hold doctors accountable, ensuring a balance between legal responsibility and professional standards.
